Co-Ownership Terms
 
Buyer agrees that “Show Potential Puppy” purchased from Breeder will be registered with the CKC under a Co-Ownership Contract and CKC Non-Breeding Agreement for the period of 24 months.  Within this time, Buyer is fully responsible for all costs associated with the puppy including, but not limited to, veterinarian care, food and supplements, grooming expenses, costs for show/competition and travel expenses, etc.  Buyer agrees to take care of the puppy to the standards outlined in the Puppy Purchase Agreement. 
 
Breeder agrees to release the CKC Non-Breeding Agreement after the age of 24 months providing the following terms are met:
 
- Cardiologist Clear (no SAS or heart condition(s) detected)
- Cystinuria Screened (if proven ‘clear by parentage’, testing not required)
- Opthamologist examined to ensure no congenial ocular issues are found
- OFA Hips, Elbow, (Patella and Shoulder) - results of ‘fair’ or better in hips and ‘normal’ for remaining tests
- Temperament Tested (TT) or Canine Good Neighbour (CGN) certified, proving temperament (optional)
- Puppy has achieved a CKC and/or AKC conformation championship title
 
and Buyer agrees to breed for the improvement of the breed and to breed with morals and decency towards their animals outlined as follows:

In Regards to Dogs:    
 
Buyer agrees:
 
- Dogs will be bred to bitches with at least the health clearances as listed above.
- Not to promote poor breeding habits by breeding bitches repeatedly for the sole purpose of profit and/or not to provide stud services to poor quality bitches and/or poor quality kennels.
- Bitches being bred will be vet certified as ‘healthy enough to be bred’, and within the previous year has had a pre-breeding screening to ensure stud dog’s safety.
- It is suggested that dogs should have a minimum of one pre-breeding screening during their breeding career to ensure diseases such as Brucella canis, Chlamydophila spp., Canine Herpesvirus, Mycoplasma spp., Ureaplasma spp., and Leptospria spp. have not been contracted and/or passed to the bitch being bred.
- Puppies produced will not be 1.)  Used for animal experimentation and/or vivisection; 2.) Sold by or to a ‘wholesale’ establishment, chain store, catalogue house, pet store, ‘puppy mill’; or 3.) Offered as a prize in a raffle.  Pet puppies produced will be sold under non-breeding agreements.
- To provide for the dog’s mental and physical well being as outlined in the Puppy Purchase Agreement.
 
In Regards to Bitches:
 
Buyer agrees:
 
- Bitches will be bred to dogs with at least the health clearances as listed above.
- Not to promote poor breeding habits by breeding bitches repeatedly for the sole purpose of profit.
- Bitches being bred will be veterinarian certified as ‘healthy enough to be bred’.
- It is suggested that bitches should have a minimum of one pre-breeding screening during their breeding career to ensure diseases such as Brucella canis, Chlamydophila spp., Staphlococcus aureus, Stephtococcus spp., Canine Herpesvirus, Mycoplasma spp., and Ureaplasma spp. have not been contracted and/or passed to the dog being bred, or puppies to be whelped.
- Bitches will not be bred before the age of 24 months, no more than two litters whelped within a 24 month period, and will not be bred past the bitch’s 6th birthday.
- The maximum number of litters whelped by the bitch will be no more than three in her lifetime.  If the bitch was bred and failed to whelp more than 2 live puppies at birth, a additional litter is approved, but only before her 6th birthday.

Issues with Conditions
 
If for some reason the conditions to lift the CKC non-breeding agreement cannot be filled, in regards to health clearances and/or breeding ethics, for any reason, Buyer and Breeder agree to discuss possible outcomes where the Co-Ownership contract may be lifted.
 
In the event that the “Show Potential Puppy” CKC non-breeding contract will not be lifted due to confirmed health issues and the puppy is deemed unsuitable for breeding, Buyer agrees to spay/neuter the puppy and treat it as a “Pet Quality Puppy”, with all the terms and conditions being met in the Puppy Purchase Agreement.  A 50% discount will be offered, to compensate Buyer, towards the purchase price of a new puppy from Breeder, from a subsequent litter of interest if puppy remains with Buyer.  If puppy is returned and papers signed over to Breeder, a replacement puppy will be offered from a subsequent litter of interest to Buyer.  Additional costs (vet bills, shipping, etc) are the responsibility of Buyer.
 
Buyer agrees if Breeder clearly states there is moral or ethical problems within Buyer’s breeding program that Breeder will not support, Buyer agrees to sign over ownership of the puppy to Breeder, and return the puppy within 30 days of being signed over.  50% of purchase price will be offered to compensate Buyer upon the safe return of the puppy.  Shipment of puppy is the responsibility of Buyer.
 
Costs associated with lifting the CKC Non-Breeding Agreement are the responsibility of Buyer.
 

Co-Ownership Breeder Rights
 
Providing there were no issues with conditions, that is the CKC Non-Breeding Agreement is released, Buyer agrees to the following co-ownership terms with Breeder:
 
In Regards to Dogs:
 
- Buyer receives full stud service fees associated with stud dog and is not required to pay portions to Breeder (except in the event of stored semen owned by Breeder). 
- Breeder may prohibit an arranged stud service proposed by Buyer if suggested bitch is not of merit, has questionable health clearances and/or is owned/resides in a kennel with questionable breeding practices/ethics that conflict with Breeder values.  Buyer agrees to respect and adhere to Breeder refusal in the event that such an issue may develop. 
- Breeder may use dog for personal breeding within own kennel, Alegup Kennels, Reg’d, with bitches Breeder owns or have leased.  Breeder agrees to pay for vet collection, semen transport kits, and shipping.
- Breeder may have dog semen collected and stored (ie: frozen) at Breeder’s expense for later use as Breeder deems appropriate, which may include very select stud services.  Fees collected for such breeding is the property of Breeder.  Semen stored by Breeder is the sole property of Breeder to which Buyer agrees to sign documentation supporting.  Buyer has no legal rights to puppies produced by Breeder stored semen.
-  Buyer is fully responsible for all costs associated with the dog including, but not limited to, veterinarian care, food and supplements, grooming expenses, costs for show/competition and travel expenses, etc.
 
In Regards to Bitches:
 
-  Buyer receives full payment for puppies produced by bitch not required to pay portions to Breeder.
-  Breeder may prohibit an arranged stud service proposed by Buyer if suggested stud dog is not of merit, has questionable health clearances and/or is owned/resides in a kennel with questionable breeding practices/morals that conflict with Breeder values.  Buyer agrees to respect and adhere to Breeder refusal in the event that such an issue may develop.
-  Breeder may prohibit sale of puppies produced by bitch to person(s)/kennel(s) with questionable ownership capability or breeding practices.  Buyer agrees to respect and adhere to Breeder refusal of sale in the event that such an issue may develop.
-  Breeder retains the right to a puppy-back from desired breeding.  Puppy will be signed over to Breeder by Buyer on full-ownership on an open registration (that is may be used for showing/breeding).  Breeder agrees to pay all costs associated with vaccinations, registration, de-worming, vet checkups, puppy health screening, and shipping of specified puppy.  Breeder agrees Buyer has first selection/choice of the litter, that is, Breeder retains second-choice puppy selection if a puppy from a specific breeding is desired.  Breeder will notify Buyer upon confirmed pregnancy of the bitch if a puppy from the upcoming litter is desired.
-  Buyer is fully responsible for all costs associated with the bitch including, but not limited to, veterinarian care, food and supplements, grooming expenses, costs for show/competition and travel expenses, etc.
 
   
Binding Agreement
 
This agreement constitutes the Co-Ownership Agreement of the parties.  Buyer acknowledges and agrees that they have read the agreement and fully understand the terms and conditions herein.  Both parties acknowledge and agree to that this is a binding contract upon both parties.
 
Assignment: Neither party shall assign this agreement to a third party.
