Agreement Breeder
agrees to sell Buyer and Buyer agrees to purchase from Breeder a Newfoundland puppy. The puppy was whelped on: ________________.

Buyer agrees to pay a deposit of $___________ prior to whelp, upon confirmation of pregnancy, for the wait list deposit. In consideration of Buyer’s Wait List Deposit, Breeder agrees to hold puppy of the sex, colour, and quality requested by the Buyer. Breeder shall apply the Wait List Deposit to the purchase price of the puppy due when Buyer takes possession of the puppy or in the event of the puppy being shipped, due prior to shipping and must include shipping costs. Should Buyer fail to take possession of the puppy, Breeder shall retain the wait list deposit to compensate Breeder for holding the puppy of the market. Wait List Deposits are
fully refundable. If Buyer requests the deposit back in writing prior to the birth of the litter being waited upon, Breeder
will return the deposit in full within 30 days of receipt of request. Once a pup of the sex, colour, and quality requested has
been born for Buyer the deposit is at that time no longer refundable and at that time may only be transferred to reserve a puppy from
a future litter from the Breeder.
Deposit
Buyer, upon the birth of the pending litter to which the Wait List
Deposit is applied, agrees to pay the $___________ Deposit to be applied to the purchase price of the puppy. This reaffirms
the Buyer’s commitment to the puppy and reduces the final amount owing at the time of pick up or shipment.
Selection of Puppy
The
selection of a particular puppy is to be done when the pups are 8 weeks of age and in the order determined by the Breeder.
Buyer’s living condition and puppy desire will be fully considered and the appropriate puppy will be matched to the Buyer. Final
decision is given to the Breeder and will be respected fully by the Buyer.
Purchase Price
The purchase price for the puppy
is _______________, (a “show potential puppy” is sold with a Co-Ownership Contract and CKC Non-Breeding Agreement until the age
of 24 months when the conditions of the co-ownership contract are met and the non-breeding agreement will be lifted) which is to be
paid in full prior to the buyer taking possession of the puppy, less the amount of any deposit(s) previously paid, except in the event
of a puppy being shipped, then the payment is due in full before the puppy is shipped including the shipping cost of _______________

Payment
Balance is due when the puppies are 6 weeks old if paying by personal cheque, 7 weeks old if paying by money order
or certified cheque, and cash is the only acceptable payment method if paying upon pickup. Puppies are normally released between
9-10 weeks of age, after their cardiology screening and last veterinarian checks have been completed.
Registration/Kennel Prefix
Show
Potential Puppy
The parties agree that this puppy is being sold as a “Show Potential Puppy”. Breeder pays for the
registration of the “Show Potential Puppy”. Buyer agrees that the puppy’s registered name will begin with the “Alegup” kennel
prefix and will follow the rules and guidelines of CKC for naming a dog. Buyer agrees that the puppy will be registered under
a CKC Non-Breeding Contract and Co-ownership with Breeder. Buyer agrees that providing the Co-Ownership Contract stipulations
have been met, the CKC Non-Breeding Contract will be lifted after the age of 24 months.
While the breeder has made every effort
to breed for healthy and quality puppies that aspire to the level of the breed standard as set by the CKC (or other registry in
the case of brown Show Potential Puppies), Breeder makes no guarantee or warranties except that listed in the Soundness Guarantee
section, and what is outlined in the Co-Ownership Contract, in regards to hereditary faults, expressed or implied, that the puppy
is of “Show Quality” and is only of possible “Show Potential”. A “Show Potential Puppy” means a dog that has the characteristics
to be able to compete in conformation events without disqualification (and does not include failure to stand for examination, foreign
substance on a dog, excused by judge, etc.). Buyer also understands that the breeder in no way warrants or guarantees the dog’s
ability to earn CKC and/or AKC points or produce offspring.
By signing the following I, Buyer, agree that the puppy I am purchasing
is a “Show Potential Puppy” and will adhere to the guidelines listed above: __________________________________.
Veterinarian
Examination/Refund Policy
Buyer shall have the puppy examined by a licensed veterinarian within 5 business days of taking possession
of the puppy. If the veterinarian determines that the puppy is ill or suffers from a congenial or hereditary defect, the puppy
may be returned to the Breeder for a full refund of the purchase price, but in order for this to be considered the puppy must be accompanied
by a letter from a licensed veterinarian stating and fully explaining the illness or problem causing the return. Buyer agrees
that any shipping costs or veterinarian expenses are the sole responsibility of the Buyer. Upon the return of the puppy to the
Breeder, Breeder has 30 days to refund to purchase price in full to the Buyer.
CKC Registration It
is after the first five days of possession and after payment clears that the Breeder shall submit the registration application to
the CKC. It is at this time the purchase is considered final.
Titles and Degrees
Buyer agrees to notify Breeder of
any titles or degrees that the dog has achieved in any competition event.
Notification
Buyer agrees to immediately
notify Breeder if at any time in the dog’s life Buyer can no longer properly care for the dog. Buyer agrees to return the dog
to Breeder at the Buyer’s expense so that the dog may be loved and cared for until an appropriate new home can be found. Buyer
will transfer all registration and paperwork into Breeder’s name. There is no refund provided for a returned pet. If the
Buyer transfers ownership or disposes of the dog in any way before notifying the Breeder they can no longer care for the dog, and
without offering to return the dog to the breeder to re-home, the Buyer agrees to compensate Breeder in the amount of $10,000.00 Canadian
dollars to ensure funding is in place to locate and retrieve the dog from their current location.
By signing the following I,
Buyer, agree to notify Breeder in the event that I am unable to care for this puppy at any point in their lifetime to allow Breeder
to find a new home for puppy. I fully agree to the terms listed above : __________________________________.
Care
of Puppy
Summary
Buyer agrees to love and responsibly care for the puppy, that is, provide proper food, water, shelter,
mental and physical stimulation, grooming, veterinarian care, and inoculations throughout the puppy’s lifetime per veterinarian instruction.
Buyer agrees that the puppy shall not be: 1.) Used for animal experimentation and/or vivisection; 2.) Sold by or to a ‘wholesale’
establishment, chain store, catalogue house, pet store, ‘puppy mill’; or 3.) Offered as a prize in a raffle.
Food, Water and
Shelter
Puppies are never to be fed any type of “puppy food” or “large breed puppy food” and the Breeder does NOT recommend that
any puppy ever be fed any such type foods EXCEPT for the initial bag of food the puppy is sent home with. At the time that bag
of food is completed, Breeder states that puppies should be fed and remain on “Innova Adult Large Breed” (diet puppies are started
on) OR “Eukanuba Large Breed Dog Food” OR “Chicken Soup for the Dog Lovers Soul, Large Breed” dry diet as they are, in Breeder’s opinion,
the most balanced diets for optimal growth, development, and maintenance of Newfoundland Dogs as has been the proven diets within
Breeder’s kennel. Puppies are to be fed according to the guidelines on the bag. If the Buyer desires to mix a wet diet
with the dry diet, Breeder recommends they select an nutritionally balanced food (certified by the Canadian or American Veterinary
Medical Association to meet or exceed recognized nutritional standards) and that the wet diet is no more than 20% of the dogs
total meal volume. Changing the puppy’s diet without prior notification and approval of Breeder may void the Soundness Guarantee.
UPC codes for this diet are to be retained and provided to Breeder as proof as diet was maintained. Buyer agrees maintain puppy
at an appropriate weight. Clean, fresh drinking water is to be available to the puppy at all times.
Buyer agrees to provide
proper shelter and/or shade to their puppy as conditions require. The puppy is not to be chained, tied, or left outdoors for
extended periods of time. Buyer agrees that the puppy will sleep in the home at night. In the event of dangerous weather
conditions, perceived pests (flies, mosquitoes, etc), or other harmful conditions, arrangements will be made to ensure the safety
and comfort of the puppy at all times.
Supplements
Buyer agrees to provide their puppy with supplements per the instructions
of Breeder. Glucosamine and MSM supplements have been proven to help prevent and/or repair degenerative joint and bone issues
and should be part of the Buyer’s disease prevention strategy. Failure to supply supplement to puppy per Breeder instructions
will void the Soundness Guarantee.
Grooming
Buyer agrees to maintain their puppy’s coat on a regular basis. Breeder
recommends Buyer take their puppy to a professional groomer at least twice per year to ensure no matting, hot spots, ear wax buildup,
or coat issues develop, as well as keeping you pet healthy, neat, tidy, and smelling good. Buyer agrees to NEVER shave their
Newfoundland Dog unless done so for a medical reason under direct order from their veterinarian.
Buyer agrees to trim the puppy’s toenails carefully and/or take the puppy to their vet and/or take the puppy to their groomer for regular nail clipping as required. Long toenails are dangerous to the puppy (prone to falling) and damage the formation of the feet causing discomfort. Teeth and Gums
Buyer
agrees to regularly supply puppy with suitable chewing items such as Kong toys, Tartar Buster (real beef knuckle treats), dried pig
ears, etc to ensure healthy teeth and gums, and to promote proper chewing behaviour. Buyer agrees to supervise puppy when chewing
any pet product. In the event of plaque and tartar buildup, Buyer agrees to take puppy to their veterinarian for cleaning and/or
gum and teeth maintenance as oral hygiene is important to overall health and longevity. Rawhide products are not recommended
as it may lead to intestinal blockages.
Veterinarian Care Buyer agrees to take the puppy to their practicing
veterinarian at least once per year for the duration of the life of the puppy and maintain inoculations and care per veterinarian’s
instructions.
Breeder vaccinates and worms the puppies accordingly beginning at two weeks of age for worming and seven weeks
of age for vaccinations. Your puppy was seen and inoculated by my veterinarian, Dr. __________________________, at the Atlantic
Veterinarian College, PEI, and was wormed as follows:

Socialization,
Obedience Training and Exercise
Buyer understands the importance of socialization, obedience training in a class setting, and
regular exercise. The puppy is going to grow into a dog between 120 lbs - 150 lbs and requires training. Obedience training
ensures puppies receive the basic instructions on how to behave in various situations, prevent accidents or harm, and provides important
social skills by meeting new dogs and people. This is mandatary for all Alegup Kennel puppies. It is advised for the puppy
to have been in at least one, six to eight week graduated obedience program, between the age of 6 months - 9 months. Breeder
agrees to assist Buyer in finding suitable training for their puppy, or may recommend a trusted trainer.
By signing the following
I, Buyer, agree to take the puppy to a Breeder approved obedience training classes and will ensure proper socialization of the puppy

Buyer also agrees to ensure the puppy will be exercised on a regular
basis. Puppies should be walked, or involved in some other activity, at least once per day for the number of minutes as the
puppy is old. For example - if the puppy is 20 weeks old, the appropriate activity time is 20 minutes. Puppies should
not be exercised to exhaustion. It is a good bonding experience, keeps your puppy’s heart healthy, and assists in keeping your
puppy at the ideal weight.
Orthopedic Foundation for Animals
Buyer agrees, within three months after the puppy reaches
the age of 24 months, to obtain the health certification as outlined in the Co-Ownership contract. Certification results will
be forwarded to Breeder to assist in Breeder's program and evaluation of future breeding plans.
The continued research and understanding
of degenerative joint issues in the Newfoundland Dog cannot take place without the complete understanding of the inheritance of this
disease. This research is made possible only with the cooperation of fellow Breeders.
By signing the following I, Buyer,
agree to participate in the continuing Alegup Kennel’s dysplaysia and heart study and understand the importance of my contribution:

Soundness Guarantee
Buyer acknowledges that Breeder has taken very reasonable
precaution to prevent the puppy from acquiring hereditary faults such as hip and elbow dysplaysia, cystinruia, and SAS (a heart disease
in Newfoundland Dogs). However, due to the hereditary and environmental causes of such faults Breeder cannot guarantee or warrant
that the puppy will not contract such diseases or ailments, BUT in the event the puppy is diagnosed within 24 months of the puppy’s
birth of one (or more) of the above screened for hereditary fault AND the fault renders the puppy as "pet quality" as outlined in
the Co-Ownership Contract the Buyer will be provided any of the options listed in the Co-Ownership Contract for a replacement puppy
or compensation as outlined.
This warranty does not cover developments that arise from preventable causes. Preventable
causes of death and/or injury include, but are not limited to:
- accidents (eg. motor vehicle accidents, choking)
- trauma (eg. rough play, slips, falls, sprains, broken bones) - poisoning (deliberate or accidental) - attack by an animal, person, or other - failure to provide proper nutrition, exercise, and supplements suitable to puppy’s age - lack of recommended preventative veterinary care Abuse, Neglect and Failure to Provide Care If, at ANY time, the Breeder is notified that the puppy is, or has been, neglected, abused,
mistreated, or has not received proper care at any point in the puppy’s life (includes, but not limited to, mental and physical abuse,
neglect, and direct or indirect harm), and upon inspection by Breeder, or party acting on behalf of Breeder in the best interest of
the puppy, it is determined that the puppy is not receiving proper care and/or is immediate danger of further damage or harm, Breeder,
or party acting on behalf of Breeder, has full right to repossess the puppy on site to remove them from the environment they are in.
Buyer will immediately supply all registration paper, health records, and documentation to Breeder, as well as sign over registration
to Breeder and will receive no compensation. The puppy will immediately receive care in the best interest of the puppy by Breeder’s
practicing veterinarian. Upon recovery of the puppy, Breeder will attempt to find the puppy a new home or, if a suitable home
is not found, the puppy will lovingly remain with Breeder.
Any expenses incurred by these actions (including but not limited
to travel expenses, veterinarian bill, or legal expenses) are the sole responsibility of the Buyer. The determination, on site,
of abuse and/or neglect is at the sole disgression of Breeder, or party acting on behalf of Breeder, and as such, final decision is
given to the Breeder and will be respected fully by the Buyer.
By signing the following I, Buyer, agree that in the event the
puppy purchased from Breeder is abused in any manner as stated above, that I will relinquish the puppy to Breeder or person acting
on behalf of Breeder, will return all documentation and sign the puppy over to Breeder, and will accept all expenses as the result
of the above actions: __________________________________.
Bill of Sale
This agreement operates not only as a purchase
agreement between two parties and documentation of the health guarantee as it applies to hereditary faults, but also as a Bill of
Sale. Breeder warrants that Buyer is the lawful owner of the puppy, that the puppy is free from all encumbrances, that Breeder
has the right to sell the puppy, and that Breeder will indemnify Buyer from all claims and actions concerning Breeder’s right to sell
the puppy.
Entire/Binding Agreement
This agreement constitutes the entire agreement of the parties. Buyer
acknowledges and agrees that they have read the agreement and fully understand the terms and conditions herein. Both parties
acknowledge and agree to that this is a binding contract upon both parties.
Assignment: Neither party shall assign this
agreement to a third party.
